Anticipatory Bail Granted in Bihar Excise Case.

The petitioner, accused in Crime No. 1134/2021 at Kankarbagh Police Station, Patna, Bihar, under various sections of the Bihar Prohibition and Excise Act, has been granted anticipatory bail by the Supreme Court. The case of Shyam Baboo Vs The State of Bihar involved the recovery of a 750 ml bottle of Indian-made foreign liquor from the roof of a hotel owned by the petitioner. Notably, the petitioner was not present at the time of the recovery.
The High Court had previously dismissed his anticipatory bail application. However, this Court, upon review, found the State's action against the petitioner to be prima facie unjustified.
Consequently, the interim protection granted to the petitioner on April 25, 2025, which was subject to his cooperation with the investigation, has now been made absolute. This means that, in the event of arrest, the petitioner is to be released on bail immediately under the usual terms and conditions determined by the concerned court. The petition and any pending applications are now disposed of.
