Appeal Dismissed: No Evidence of Cruelty or Abuse in Matrimonial Dispute.


This criminal appeal challenges the acquittal of the private respondents in a case involving allegations of cruelty, harassment, and unlawful demands under Sections 498A, 323, 504, and 506 of the IPC. The appellant, who is the complainant and wife of the first respondent, claims that after their marriage on June 26, 2011, her husband and his family subjected her to cruelty by making illegal monetary demands.

 

 

The prosecution presented two key incidents: one on January 7, 2012, when the appellant alleges that her husband demanded Rs.1,50,000 and assaulted her, and another on September 18, 2012, involving a similar demand for Rs.1,50,000 for the husband’s transfer. However, no corroborative evidence was presented to support these allegations, including medical evidence or documentation of injuries. Additionally, the prosecution failed to prove the demand for money, as the first respondent was already employed before the marriage, and no evidence was provided to substantiate the requests for money.

Both the trial court and the appellate court dismissed the charges, finding the evidence presented by the prosecution insufficient and unreliable. They noted that the testimony of the appellant and her family members contained discrepancies, and no solid evidence of cruelty or abuse was provided. The prosecution’s failure to prove the case beyond reasonable doubt led to the exoneration of all respondents.
After reviewing the evidence and the judgments of both the trial court and the appellate court, the appeal was dismissed, and the acquittal of the respondents was upheld.
