Two applicants facing potential arrest in a Jabalpur case have been granted anticipatory bail by the court. The case (FIR/Crime No.98/2024) registered at Bargi Police Station involves charges under Sections 294 (obscene acts), 323 (voluntarily causing hurt), 327 (hurting with intent to cause grievous hurt), 506 (criminal intimidation), and 34 (common intention) of the Indian Penal Code (IPC).
The applicants claimed innocence and argued they were falsely implicated. They also presented a no-objection statement from the complainant.
The court, while reserving judgment on the merits of the case, allowed the anticipatory bail application. This means the applicants will be released on bail if arrested.
Bail Conditions:
- Each applicant must furnish a personal bond of Rs. 50,000/- with a surety of the same amount.
- Upon chargesheet filing, fresh bail bonds need to be submitted before the trial court.
- The applicants are required to:
- Cooperate with police questioning.
- Refrain from influencing witnesses.
- Comply with other conditions mandated under Section 438(2) of the CrPC.
- If not arrested, the applicants must surrender to the investigating officer within 15 days and participate in the investigation.
- Any violation of these conditions will render the anticipatory bail order ineffective.
