Bail Granted by the Supreme Court After Five Years in Dowry Death Case.


The Supreme Court has granted bail to a petitioner accused in Crime No. 364/2020, registered at Police Station Shankargarh, District Prayagraj, Uttar Pradesh. The petitioner was charged under Sections 498A and 304B of the Indian Penal Code, and Sections 3/4 of the Dowry Prohibition Act. His second bail application had previously been dismissed by the High Court.

The petitioner has already been incarcerated for approximately five years. The prosecution alleges that the case involves hanging by suicide.

 

 
 
 

Considering the significant period of incarceration and other relevant factors, the Supreme Court determined that a case for bail was made out for the petitioner. Notice had been issued in the matter on April 25, 2025, and as per the office report dated July 15, 2025, the State had not filed a counter-affidavit despite being served notice.

Consequently, the petitioner is directed to be released on bail immediately, subject to the usual terms and conditions to be decided by the concerned Court. The petition, along with all pending applications, stands disposed of.
