Bombay High Court Directs Renewal of Passport for Petitioner Despite Pending Criminal Case.

In Sangram Ashok Swami v/s Regional Passport Office, Pune & Others., the petitioner sought to renew their passport for a 10-year period. They were initially accused in two criminal cases, but one was dismissed with an acquittal. The remaining case is still pending. 


 

 

The petitioner had applied for urgent renewal of their passport, but due to the absence of a police verification report, it was issued without full disclosure of the criminal charges. Upon receiving an adverse police verification report, the passport was cancelled. The petitioner has now re-applied for renewal, providing full details of the pending case. The court, after reviewing the matter, directed the renewal of the passport for 10 years in compliance with the Passport Act, noting that the petitioner must seek permission from the trial court before traveling abroad.
