Bombay High Court Rejects Petition to Alter Date of Birth in Service Records; Imposes Fine and Orders Investigation.

The Petitioner, who joined the institution as a clerk in 1997, sought to make himself appear four years younger. However, school records confirm his birthdate as 2nd June 1968, and the Court highlighted the implausibility of his claim, noting that under the proposed birthdate, he would have been just 11 years and 9 months old when passing his 10th Standard in 1984, which would imply he started school at the age of one.
The Court dismissed the petition, imposing a fine of Rs. 25,000, which was to be deducted from the Petitioner’s salary and deposited in the Kirtikar Law Library. Furthermore, the Court directed the District Collector of Sangli to investigate the actions of the Sub-Divisional Officer, who had previously corrected the Petitioner’s date of birth, and take appropriate action after hearing explanations.
