Bombay High Court Ruling Ensures Shelter for Senior Citizens Amidst Redevelopment Delays in Maharashtra.

In a landmark judgment of Jayashree Dilip Dholi v/s The Deputy Registrar of Co-operative Housing Societies, T Ward, Mulund West dated 25th January 2024, the Bombay High Court intervened to address the grievances of senior citizens facing prolonged delays in the redevelopment of their residences, urging both the State Government and relevant authorities to take urgent steps to safeguard their fundamental rights. The Court’s intervention focused on ensuring that senior citizens, particularly those who have vacated their homes for redevelopment, are not left homeless or subjected to undue hardship due to project delays.
The Petitioner's Plea: Protection of Senior Citizens' Rights
The petition was filed by a senior citizen, who, along with other elderly residents, had vacated their premises for the purpose of redevelopment. However, the redevelopment had stalled, leaving them without a roof over their heads. The petitioner highlighted the dire situation of these senior citizens, who have been living without homes for over four years. Their fundamental rights, as guaranteed under Articles 14 and 21 of the Indian Constitution, were being violated, as they were deprived of basic shelter in their twilight years. The petitioner pointed out that this situation was exacerbated by the alleged illegal functioning of the managing committee of their housing society, which, she claimed, had failed to prioritize their needs.
The Court observed that senior citizens should not be left to suffer in their old age, particularly when the delay in redevelopment projects impacts their access to housing. It emphasized that the State, under the Constitutional framework, has a duty to ensure that senior citizens are provided with shelter and that their rights to basic amenities and shelter are not compromised by the failures of housing societies or developers.
State Government's Response: Policy and Directives
In response to the Court's observations, the Government of Maharashtra moved swiftly. On 4th March 2024, the Housing Department issued a comprehensive circular addressing the concerns raised by the Court. This circular outlined a series of measures aimed at ensuring that senior citizens are not adversely affected by delays in redevelopment projects.
The key provisions of the circular include the following:
Timely Redevelopment: The Maharashtra Housing and Area Development Authority (MHADA) and other relevant authorities were directed to take steps to ensure the completion of redevelopment projects within the stipulated timelines. Special emphasis was placed on avoiding any delays that would affect senior citizens.
Project Monitoring and Accountability: The establishment of a Project Implementation and Controlling Committee was mandated. This committee will include senior citizens’ representatives and will meet monthly to review progress. In case of delays, the developer will face strict actions, including show-cause notices and potential termination of the contract.
Grievance Redressal: The government set up a grievance redressal system to address complaints from senior citizens about redevelopment delays. A designated officer at MHADA will be responsible for resolving such complaints, ensuring that the grievances of senior citizens are heard and acted upon promptly.
Priority in Amenities: The circular directs that redevelopment projects must incorporate facilities and amenities suited to the needs of senior citizens, including ramps and accessible infrastructure, in line with the Rights of Persons with Disabilities Act, 2016.
Special Monitoring Cell: The state government was instructed to establish a dedicated "Special Cell" to oversee redevelopment projects involving senior citizens. This cell will ensure that projects are completed expediently and that any disputes or delays are promptly addressed.
Court's Observations and Directions:
The Bombay High Court expressed satisfaction with the proactive approach adopted by the State Government and commended the efforts of both the government and the petitioner in addressing the issue. It highlighted that the protection of the fundamental rights of senior citizens, particularly the right to shelter, must remain a priority.
The Court emphasized that the authorities must implement the policy with utmost diligence, ensuring that the directives are followed in letter and spirit. Moreover, the Court directed the relevant authorities, including MHADA, MMRDA, and SRA, to monitor redevelopment projects involving senior citizens and take immediate action in case of delays.
To further safeguard the interests of senior citizens, the Court also recommended that the State Government create a special system for monitoring these projects, including a dedicated postal address, email, and helpline for senior citizens to file their grievances. This will ensure that their concerns are addressed without delay.
Resolution of Disputes and Future Steps:
In the specific case brought before the Court, the petitioner’s redevelopment project was entangled in internal disputes among society members. The Court encouraged the involved parties—the society, the developer, and the petitioner—to work together to resolve their differences amicably. A meeting was scheduled for March 18, 2024, to discuss and resolve the disputes, with the goal of ensuring the redevelopment project moves forward without further delays.
The Court noted that any further litigation would only exacerbate the situation and delay the redevelopment, which would be detrimental to both the senior citizens and the other members of the society. The Court urged all parties to prioritize the completion of the redevelopment project for the welfare of the elderly residents.
