Child Custody Case Transferred to Mohali Family Court for Expeditious Resolution.

The Supreme Court has granted a transfer petition, moving the child custody case (G&W Act No. 10/2022, titled “Piyush Sharma vs. Neha Sharma & Anr.”) from the Principal Judge, Family Court, Kangra, Dharamshala, Himachal Pradesh, to the Principal Judge, Family Court, Mohali, Punjab. This decision was made in the interest of justice.

The transferee court in Mohali is directed to either hear the case itself or assign it to a competent court. All case records are to be immediately transferred.

 

 

To avoid delays, both parties in the case are directed to appear before the Mohali Family Court on July 14, 2025. On this date and subsequently, parties have the option to appear in person, through authorized representatives, or via video-conferencing if the facility is available. Should any party fail to appear, the transferee court will issue a notice to them.

The Court also suggested that the parties explore the possibility of settlement through mediation, and the Mohali Family Court may ascertain their wishes in this regard and proceed accordingly. The transferee court is further instructed to decide the matter expeditiously.

All pending applications in the case are now disposed of.
