A recent court order has ensured a pregnant teenager receives medical treatment without being pressured to file a police report. The 17-year-old girl's mother petitioned the court after hospitals refused care due to the lack of a report.
Confidentiality and Right to Health Upheld:
The court emphasized the girl's right to health under Article 21 of the Constitution, guaranteeing the right to life and livelihood. The order condemns the practice of hospitals denying treatment based on the absence of a police complaint.
Consensual Relationship, No Charges Desired:
The court acknowledged the consensual nature of the relationship between the teenager and the father of the baby, who is also a minor. The girl and her mother clearly stated their intention not to press charges.
Court Order Ensures Care:
The court mandated the following:
- The mother will submit a written statement about the case (EPR) to the court.
- Sir J.J. Group of Hospitals will provide confidential medical care to the girl under a pseudonym ("ABC").
- The girl will receive pre-natal, delivery, and post-natal care at Sir J.J. Group of Hospitals.
- St. Catherine's Home will offer shelter with confidentiality.
The court left the issue of adoption for future determination.
This case highlights the importance of balancing legal requirements with the right to healthcare, particularly for vulnerable individuals. The court's order ensures the teenager receives proper medical attention while respecting her privacy and wishes.
