Consequences for Olisa Reality Pvt. Ltd.: Order Debarment and Goods Replacement Directive.

Background:
Olisa Reality Pvt. Ltd. was issued a show cause notice on December 15, 2023, following an inspection on December 5-6, 2023, which revealed discrepancies in the B-Twill jute bags they supplied. The inspection found several anomalies, including unbranded and improperly marked bags, as well as tampered seals on bales. These issues led to the seizure of 150 bales and the issue of a show cause notice to the company.

 

 

Hearing and Submissions:

During the hearing held on April 1, 2024, the department presented evidence, including samples of defective bags. The department argued that the company had admitted guilt, while the company contended that the discrepancies were due to employee negligence and not intentional malpractice. The company maintained that the issues were minor and should not affect their business operations.

Inspection Agency's Role:

The inspection agency, M/s Eskaps, confirmed the presence of tampered seals and mixed bales from different crop years, supporting the department's claims.

Order:

The adjudicating authority determined that the allegations against Olisa Reality Pvt. Ltd. were substantiated. Consequently, the company is debarred from receiving PCSO orders for three months from the date of the order. The company must fulfill any pending orders and replace defective goods at their own cost within a fortnight. The company has the option to appeal this decision in accordance with the Jute & Jute Textiles Control Order, 2016.
