Court Approves Settlement in Motor Accident Dispute.

A recent court order has brought closure to a motor accident case. The appeal, filed under Section 173 of the Motor Vehicles Act, 1988, involved a dispute over compensation awarded by the Motor Accident Claims Tribunal.

Background:

The Tribunal had originally awarded Rs. 8,11,000 to the claimants (Smt. Munni and Others) in their case against the United India Insurance Company and another party. However, the appeal against this award was delayed by 32 days. The court, however, condoned the delay, allowing the appeal to proceed. During the proceedings, both parties reached an amicable settlement. The claimants agreed to accept a reduced compensation amount of Rs. 5,00,000. This proposal found approval from the court.

 

 

Conclusion:

The court order modified the original award, reflecting the agreed-upon settlement. It directed the Tribunal to release Rs. 5,00,000 to the claimants. The remaining amount (Rs. 3,11,000) will be returned to the appellant. Additionally, the court ordered the release of Rs. 25,000 to the appellant, likely related to court fees.
