The petitioner filed a grievance regarding the delay in processing Bill of Entry No. 8048557, dated 28 September 2023, for re-imported goods, specifically medicaments, whose shelf life had expired due to the delay. The petitioner sought compensation of Rs. 80,435.85 for the loss incurred.
The respondents presented several difficulties in processing the bill, but the court emphasized that despite these challenges, the respondents are obligated to process the Bill of Entry in accordance with the law. The court refrained from directing the respondents on how to exercise their powers but stressed the need for timely action.
In response, the court directed the respondents to process the petitioner’s Bill of Entry within four weeks from the date of the order, ensuring the process is done in accordance with the law and on its merits. The respondents were also instructed to work collaboratively rather than blaming each other for the delays.
Regarding the compensation claim, the court did not entertain it at this stage, allowing the petitioner to seek alternative remedies. The petition was disposed of with the directive to process the Bill of Entry within the specified timeframe and communicate the outcome to the petitioner.
