A former Central Industrial Security Force (CISF) constable's challenge to his dismissal has been rejected by the court. The case centred on the fairness of the disciplinary proceedings and the seriousness of the alleged misconduct.

The constable faced dismissal following a departmental enquiry into accusations of serious misconduct and indiscipline. These included disobeying an order to report to a superior, attempting to pressure his superiors through relatives, and creating a viral video where his wife criticized the CISF administration.

The constable argued his dismissal was unlawful because he didn't receive a timely Hindi translation of documents needed for his defense, wasn't given a proper opportunity to defend himself, and received an excessively harsh punishment.

The CISF countered that the constable had ample opportunity to defend himself but missed deadlines. They argued his actions, including the viral video, warranted dismissal, and his past disciplinary record showed a pattern of misconduct.

The court sided with the CISF, dismissing the constable's petition. The court acknowledged the request for a Hindi translation but found no evidence it caused significant harm to the defense. While the right to be heard is important, the constable's failure to meet deadlines within the established procedures weakened his position.

The court focused on the seriousness of the constable's overall conduct. This included the repeated disciplinary issues and the deliberate attempt to damage the CISF's reputation through the video. The court concluded that the combined offenses justified the harsh penalty of dismissal.

This case highlights the importance of following proper disciplinary procedures within the CISF. While the right to defend oneself is essential, delaying tactics can hinder a defense. Additionally, the court emphasized the seriousness of the constable's actions, particularly the attempt to publicly discredit the CISF, which ultimately justified the dismissal.
