Court Grants Bail in NDPS Case Citing Right to Liberty.


A Petitioner identified as accused No. 4 in Cr. No. 19/2024 of Ashokpuram Police Station was granted bail by the court recently. The Petitioner was arrested under the Narcotic Drugs and Psychotropic Substances Act (NDPS Act) for allegedly supplying ganja.

The Petitioner's defense argued that he was falsely implicated in the case and that no ganja was recovered from him during the investigation. The prosecution, on the other hand, contended that accused Nos. 1 to 3 had named the petitioner as their supplier.

 

 

The court, after considering the arguments and the fact that no contraband was found on the Petitioner's person, determined that detaining him any further would infringe on his fundamental right to life and liberty. Additionally, the Petitioner had no prior criminal record.

Considering these factors, the court granted bail to the Petitioner. The bail amount was set at Rs.2,00,000/- with two sureties. The Petitioner is also required to adhere to certain conditions, including not committing similar offenses in the future, refraining from threatening or tampering with prosecution witnesses, and appearing in court as mandated. The court has also authorized the trial court to verify the Petitioner's address and the authenticity of the documents submitted by him and the sureties.
