Bail and Antcipatory Bail >> Criminal Law
Three applicants have been granted bail by the court after being arrested for allegedly transporting contraband liquor.
The applicants were arrested in connection with a First Information Report (FIR) filed at the Deesa Rulra Police Station in Banaskantha, Gujarat. The FIR, registered with the number C.R.NO. 11195019240110 of 2024, accused them of transporting 432 bottles of liquor worth Rs. 2,05,200/-.
According to the court order, the prosecution opposed bail due to the nature and seriousness of the offense. However, the court, after considering the arguments and the fact that the investigation is complete and a charge sheet has been filed, deemed it a fit case for bail.
Bail Granted with Conditions:
Each applicant was granted bail upon furnishing a personal bond of Rs. 10,000/- with one surety for the same amount. Additionally, they are subject to several conditions, including:
- Not misusing their liberty or acting in a way that harms the prosecution's case.
- Cooperating with the police investigation and not tampering with evidence.
- Surrendering their passports (if any) within a week to the trial court.
- Obtaining permission from the court before leaving the state of Gujarat.
- Marking their presence at a designated police station once a month for six months.
- Providing their current addresses to the court and police and not changing residences without court permission.
The applicants also face specific restrictions based on their alleged past offenses. Applicant no. 1 is prohibited from entering the areas of Khedbrahma and Harij Police Stations, while applicant no. 2 is barred from entering the Viramgam Police Station area. These restrictions remain in place until the trial concludes, with exceptions for attending court proceedings and marking their presence at the police station.
The court order clarifies that the applicants will only be released if they are not wanted in connection with any other ongoing case. It also emphasizes that the trial court should not be influenced by the preliminary observations made during the bail hearing.
