Court Rejects Anticipatory Bail of Advocate in Forgery and Fraud Case.

In Hiral Chandrakant Jadhav v/s The State of Maharashtra., the Applicant, an advocate, sought anticipatory bail in connection with a fraud case registered under Sections 420, 465, 467, 468, 471, and 466 of the IPC. The complainant (first informant) had approached the Applicant to secure bail for her husband, who was arrested under Section 302 IPC. The Applicant charged a fee of Rs. 65,000 and promised to arrange the bail, which she failed to do. 

 

 

Instead, the Applicant provided forged bail orders and receipts, repeatedly assuring the informant of her husband's release. Despite multiple attempts by the informant to deposit the bail documents at the prison, the documents were found to be fake, leading to a realization of fraud. The informant confronted the Applicant, who tried to intimidate her. The investigation revealed that the bail order and receipt were forged, and the bail application had been rejected long before. The Applicant's actions were deemed dishonest and fraudulent, causing significant mental and emotional harm to the informant.

The court rejected the anticipatory bail application, citing that the Applicant’s actions amounted to serious criminal offenses, including forgery and cheating, and that custodial interrogation was necessary to uncover potential accomplices.
