Court Upholds Removal of Developer in Stalled Slum Redevelopment Project.


A developer appointed to revive a slum area in Mumbai has been replaced by the Slum Rehabilitation Authority (SRA) due to delays in implementing the project. The decision comes after a legal dispute between the developer and the SRA.

Background:

The project involved redeveloping a slum area designated for rehabilitation and resettlement under Mumbai's development plan. The developer was appointed by the society of slum dwellers in 2019. However, the project faced several hurdles. Eviction notices were issued to slum dwellers by the Municipal Corporation of Greater Mumbai (MCGM), causing complications.

The developer argued that the delays were caused by various factors, including the COVID-19 pandemic lockdown and the eviction notices. They also claimed a genuine belief that a court order restricted new rehabilitation schemes, although this belief was later disputed.

SRA's Response:

The SRA countered that the developer was responsible for the excessive delays in obtaining approvals and taking necessary steps to move the project forward. They further argued that the developer failed to challenge the SRA's perceived inaction regarding the supposed court order restriction, which the SRA claims was a misunderstanding. Additionally, the SRA pointed out a loss of faith among slum dwellers due to the prolonged wait.

Court's Decision:

The court sided with the SRA, dismissing the developer's petition. The judge acknowledged the unreasonable delay and agreed with the SRA's authority to replace the developer in such cases, even if there were no formal breaches of agreements.

The court cited the judgement in "New Janta SRA CHS Ltd v. The State of Maharashtra" to support the SRA's right to appoint a new developer when delays hinder project progress.
