Background:
The shopkeepers, referred to as the petitioners in court, argued that vehicles parked by the respondents (other parties involved) obstructed customer access to their shops. They received a temporary injunction from the trial court, which prohibited parking in the disputed area.
However, the respondents appealed the decision. They claimed the shops were illegally built and the petitioners lacked proper ownership documents. The first appellate court sided with the respondents, reversing the injunction.
Court's Reasoning:
The higher court disagreed with the first appellate court's decision. It found that the appellate court failed to consider the trial court's primary concern: obstructed access due to parking. While acknowledging the need for a separate authority to determine land ownership, the court emphasized that the shops undeniably exist and operate businesses.
Furthermore, the court criticized the first appellate court for not analyzing whether the trial court misused its discretion when granting the injunction.
Court's Decision:
The court ultimately overturned the first appellate court's order. It reinstated the temporary injunction, ensuring the disputed area remains free from parked vehicles and allowing for easier customer access to the shops.
The court also ruled that each party involved will bear their own legal costs.
