A daughter, J. Vasanth Kumari, successfully defended a lawsuit filed by her mother, Saraswathamma, regarding a property dispute. The court ruled in favor of the daughter as the lawsuit was filed beyond the limitation period.
Saraswathamma sought to challenge a gift deed she had signed in favor of her daughter in 2004, along with a partition deed from 2002. However, she waited until 2019 to file the lawsuit, which exceeded the legal limit to contest these documents.
The court pointed out that Saraswathamma freely admitted to signing the gift deed willingly and did not claim any coercion or manipulation. Furthermore, the significant delay in filing the lawsuit rendered her claims unactionable.
