Daughter's Testimony of Police Misconduct Leads to Bail, Probe Ordered.

In a recent judgment, the High Court of Rajasthan granted bail to a defendant (hereinafter "Appellant") in a murder case while simultaneously directing a probe into potential police misconduct. The Appellant, identified in court documents as Ramveer, stands accused of the fatal shooting of his spouse.

During the ongoing trial, a critical prosecution witness, PW-2, the deceased's 14-year-old daughter, provided a pivotal testimony. Her unchallenged statement detailed witnessing the murder and subsequent threats from the Appellant.

 

 

However, PW-2's testimony took a more concerning turn when she alleged that law enforcement officers initially suspected her of the crime itself. She described being subjected to intimidation tactics and physical assault by police in an apparent attempt to coerce a confession.

The Court, deeming these actions to constitute "serious misconduct" with potential criminal implications, directed the Director General of Police (DGP) of Rajasthan to initiate a formal investigation. This investigation will encompass both potential disciplinary measures within the police department and a potential criminal inquiry.

While the Court granted bail to the Appellant, it simultaneously underscored the gravity of the misconduct allegations. The case has been adjourned until April 26, 2024. On that date, the DGP is expected to submit a report detailing the investigation's progress. This follow-up signifies the Court's firm commitment to ensuring accountability for any officers implicated in the alleged misconduct.
