Delayed Electricity Connection? Consumer Awarded Rs. 5 Lakh Compensation.


A recent order by the National Consumer Disputes Redressal Commission (NCDRC) highlights the importance of timely service delivery by utility companies. The case involved a petitioner who had applied for a loan to set up a spice unit and faced significant delays in obtaining an electricity connection.

The petitioner, classified as a consumer under the Consumer Protection Act despite the commercial nature of the unit, argued that the electricity distribution company (respondent) had been negligent in providing the connection. This delay, exceeding two years, forced the petitioner to run the unit on a diesel pump, leading to increased operational costs and financial losses.

 

 

The petitioner sought compensation for the financial losses and the mental agony caused by the delay. The District Forum initially awarded Rs.50,000 compensation along with litigation costs. The State Commission acknowledged the mental strain and enhanced the compensation to Rs.1 lakh.

However, the NCDRC found both lower court awards to be insufficient. They emphasized the mental suffering and financial burden placed on the petitioner due to the respondent's deficient service. The NCDRC specifically rejected the respondent's arguments regarding incomplete internal wiring as a justification for the delay.

Ultimately, the NCDRC increased the compensation amount to Rs.5 lakh, recognizing the significant impact of the delayed connection. This case serves as a reminder for utility companies to prioritize timely service delivery and address consumer grievances effectively. It also underlines the NCDRC's commitment to ensuring fair compensation for consumers who experience deficiencies in service.
