Delhi High Court Halts Proceedings in Road Accident Case Following Victim-Accused Settlement.

In Arpit Kumar v/s State NCT Of Delhi & Another a petition was filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to quash FIR No. 512/2022. This FIR was registered under Sections 279 and 338 of the Indian Penal Code (IPC) at PS Amar Colony. The petition arose from a road accident on September 1, 2022, where Deepak Bouthiyal (complainant) sustained grievous injuries after being hit by a motorcycle driven by Arpit (petitioner).

Following the incident, a case was registered against Arpit. However, during the proceedings, both parties reached an amicable settlement on October 21, 2024, at the Saket mediation center. As per the Compromise/Settlement Deed, Arpit agreed to pay Rs. 45,000/- to Deepak Bouthiyal as full and final settlement.

 

 

Both the petitioner and the respondent confirmed the settlement to the court, with the respondent affirming receipt of the settlement amount and expressing no objection to the quashing of the FIR and all related proceedings. The Additional Public Prosecutor, representing the State, also had no objection to the quashing.

Referencing the Supreme Court's decision in Gian Singh vs State of Punjab (2012) 10 SCC 303, which emphasizes the importance of amicable dispute resolution, the court determined that continuing the criminal proceedings would serve no useful purpose given the settlement.

Therefore, in the interest of justice, the petition was allowed, and FIR No. 512/2022, along with the charge sheet and all consequential proceedings, was quashed. The petition and any pending applications were accordingly disposed of.
