In Geeta Bedi v/s State (NCT Of Delhi) & Another a petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to quash a criminal complaint (CC No. 25321/2016) lodged under Section 200 of the Cr.P.C. for alleged offenses of cheating, forgery, and using forged documents (Sections 420, 467, 468, 471, 34 of the Indian Penal Code).
The dispute arose when Respondent No. 2, who inherited a shop from his grandmother, discovered a forged will and a fraudulent transfer application related to the shop, leading him to file the complaint against the Petitioner.
However, the parties have since amicably resolved their differences and formalized this resolution through a Settlement Deed dated May 14, 2023. All prior litigations have been withdrawn, and the Petitioner has paid the agreed-upon settlement amount of Rs. 3,25,000/- to Respondent No. 2.
Both parties were present in court and confirmed the settlement was reached without coercion. Respondent No. 2 explicitly stated he has no objection to the complaint being quashed. The Additional Public Prosecutor, representing the State, also concurred with the quashing.
Referencing the Supreme Court's ruling in Gian Singh vs. State of Punjab (2012), which emphasizes the importance of amicable dispute resolution, the court determined that continuing the criminal proceedings would serve no useful purpose and would be an abuse of legal process, given the complete settlement between the parties.
Consequently, the petition was allowed, and Complaint No. 25321/2016, along with all associated proceedings, has been quashed in the interest of justice.
