Delhi High Court Secures Release of Petitioner Unlawfully Detained in Tihar Jail.


The Delhi High Court, in a recent habeas corpus petition, ordered the immediate release of a petitioner who was unlawfully detained in Tihar Jail despite a valid bail order.

Facts:

The Petitioner, whose identity remains undisclosed, was granted bail in a Delhi case. However, his release was impeded due to the existence of a production warrant issued by a court in GB Nagar (outstation court) in September 2022. This warrant, mandating the Petitioner's production before the GB Nagar court on a specific date in October 2022, had since expired.

Dereliction of Duty by Jail Authorities:

Despite the warrant's expiration, Tihar Jail authorities failed to undertake due diligence to verify its current validity. This resulted in the Petitioner's continued incarceration even after securing bail in the Delhi case. The Court's order explicitly criticizes this lapse, highlighting a potential communication gap within the jail administration.

The High Court, recognizing the Petitioner's unlawful detention, directed his immediate release (habeas corpus relief). Furthermore, the Court mandated disciplinary action against the erring jail officials responsible for the oversight. The Director General (Prisons) assured the Court of stricter adherence to established protocols regarding production warrants and release procedures.
