The appellant, a former conductor of the Rajasthan State Road Transport Corporation, appealed against a High Court ruling that set aside previous judgments favoring him regarding his dismissal in 1982. The appellant was terminated due to ticketing errors and failure to prevent fare evasion, but a trial court had previously ruled his dismissal illegal, citing a lack of fair hearing.
The High Court concluded that the civil courts lacked jurisdiction over the case, suggesting the appellant should have pursued remedies under the Industrial Disputes Act, 1947. In the appeal, both parties presented arguments regarding jurisdiction and the validity of the dismissal.
Considering the significant time since the appellant's dismissal and potential superannuation, the Supreme Court opted to award a lump sum compensation of ?2,00,000 instead of addressing the jurisdictional issues. The appeal was resolved by granting this compensation, with no costs ordered.
