From Mixed-Up Luggage to Bail: Man Challenges Train Ganja Case.

A bizarre mix-up on a train led to a man's arrest in a drug case, but a recent court decision highlights the importance of concrete evidence. Subhash Kumar Yadav found himself in hot water after an unclaimed suitcase containing Ganja (cannabis) was discovered where his own luggage should have been. The twist? Train tickets booked from Yadav's phone were linked to the seats where the drugs were found.

Facts:

The case began in October 2023 when Binod Kumar Sakuja reported his suitcase switched with another containing Ganja on a train arriving at New Delhi Railway Station. An FIR (First Information Report) was filed, and investigation revealed the tickets for the seats where the Ganja was found were booked through Yadav's mobile number. Yadav argued he had no connection to the drugs and only booked the tickets for another person, Bijya Laxmi, at the request of someone named Babula Khara.

 

 

Conclusion:

The court acknowledged the lack of direct evidence linking Yadav to the Ganja itself. They considered the length of his detention since October 2023 and the fact that the prosecution's case relied heavily on the ticket booking. Based on these factors, the court granted Yadav bail with conditions including a financial bond and keeping authorities informed of his whereabouts. While Yadav has been granted bail, the underlying case continues. The trial will determine his guilt or innocence based on the presented evidence.
