The case centered on the appointment process for a vacant Tax Inspector position. The Council opted for direct recruitment through the Employment Exchange, and Respondent No. 1, who possessed the necessary qualifications, was recommended and interviewed. Although Respondent No. 1 went through the proper channels, his initial appointment was limited to six months, possibly due to concerns about the post lapsing if unfilled. However, he continued serving as Tax Inspector, exceeding ten years of total service. The Council challenged the regularization order issued by the Industrial Court. They argued Respondent No. 1 wasn't qualified and his appointment bypassed proper procedures.

The Court dismissed the Council's arguments, citing several factors:

  • The Tax Inspector position was a sanctioned post.
  • The Council demonstrably followed proper recruitment procedures.
  • Respondent No. 1 had the required qualifications and underwent an interview.
  • He served for over ten years, exceeding the minimum for regularization in such cases.

The Court also criticized the Council for suppressing crucial details, such as obtaining no-objection certificates from senior employees for direct recruitment.
