High Court Declines Expedited Hearing for 2016 Suit.

In Raj Kumar v/s Manoj Kumar & Others., the High Court has declined the petitioner's request for the expedited disposal of a suit filed in 2016. While the petitioner's counsel stated that the case had previously reached the final arguments stage, progress stalled after the defendant was permitted to file an amended written statement. Currently, the case is at the stage of plaintiff's evidence, following the framing of additional issues by the Trial Court on December 16, 2024.
The Court's decision aligns with the established legal principle that Constitutional Courts generally do not issue directions for expedited disposal without exceptional circumstances. As no extraordinary reason or hardship was presented by the petitioner, the High Court refrained from intervening.
However, the Court clarified that the petitioner is at liberty to submit an appropriate request to the Trial Court. Should such a request be made, the Trial Court is expected to consider it in accordance with the law and its own board position. The petition and any pending applications have been disposed of.
