High Court Grants Anticipatory Bail to Appellant in Financial Dispute Case.


In a significant legal development, the High Court of Chhattisgarh at Bilaspur has ruled in favor of granting anticipatory bail to an appellant in a case involving allegations of fraud. The Court's decision, made on April 25, 2024, pertains to the appellant's request for anticipatory bail in connection with Crime No. 243/2023.

The case revolves around an FIR filed on November 26, 2023, at the Gidhouri Police Station in the District of Balodabazar-Bhatapara, Chhattisgarh. The appellant faces accusations under Section 420 read with Section 34 of the Indian Penal Code, which relate to charges of cheating and criminal conspiracy. The allegations stem from an incident reported to have occurred on January 25, 2021.

 

 

The appellant's counsel argued that the current FIR was filed only after a delay of nearly three years following the alleged incident. They contended that the case was a mere loan dispute and that the appellant had been falsely implicated. The counsel also highlighted that the appellant had previously been granted anticipatory bail in a related FIR filed by the brother of the current complainant, Dhaneshwari Devangan.

After considering the arguments and reviewing the case materials, the High Court decided to grant anticipatory bail to the appellant. The Court's order stipulates that if the appellant is arrested in connection with the case, they shall be released on bail. The release will be subject to terms and conditions that the Trial Court deems appropriate.
