High Court Maintains Spousal and Child Support Award.

A recent order by the High Court upheld a family court's decision regarding spousal and child maintenance. The husband had appealed against the amount awarded and also raised allegations of adultery against his wife.

The husband initially filed an application seeking to excuse a delay in filing his appeal. The court allowed this application and proceeded to hear the main appeal concerning the maintenance amount.

 

 

The wife had been granted Rs. 75,000 per month for herself and their daughter. The husband contested this amount, arguing that his income was misrepresented by the family court. However, the High Court found the family court's reasoning on income to be sound and dismissed the husband's appeal.

The husband also presented photographs as evidence that his wife was living in adultery. The court acknowledged these photographs but noted that the husband hadn't raised this allegation in his initial response to the wife's maintenance request. Furthermore, the court considered the possibility that the photographs could be manipulated and suggested the husband pursue this claim in the ongoing divorce proceedings with proper evidence.

In conclusion, the High Court's order upheld the family court's decision on maintenance, dismissing both appeals filed by the husband.
