High Court Upholds Land Deal Agreement in Dispute Between Landowner and Society.


A recent ruling by the High Court has settled a long-standing dispute between a landowner and a cooperative society regarding a plot of land. The case involved a complex agreement for development purposes that went awry, highlighting the importance of following court-sanctioned settlements.

Background:

The story began in 1980 when a landowner (petitioner) constructed two buildings with wings A and B on a portion of their land. Flats and shops in these buildings were then sold to the respondent society. However, disagreements arose concerning the development of the remaining land.

 

 

Settling the Score: Consent Terms and Decrees

These disagreements were eventually resolved through "consent terms and consent decrees" passed by the Civil Court. These legally binding agreements outlined the rights and obligations of both parties:

  • The landowner would convey the entire plot to the society.
  • The society, in turn, would execute a lease agreement in favor of the landowner for a specific area.
  • Importantly, the landowner retained the right to develop the remaining land.

Twist in the Tale: Society Seeks Deemed Conveyance

Despite these clear agreements, the society approached a competent authority under MOFA (Maharashtra Ownership Flats Act) without disclosing the existing consent terms. They sought a "deemed conveyance" – a legal transfer of ownership – for the entire plot, exceeding what was agreed upon. The landowner, upon learning of this maneuver, challenged the competent authority's order in the High Court. They argued that the order disregarded the binding consent terms and consent decrees.

High Court Delivers Verdict: Agreements Upheld

The High Court sided with the landowner. The Court's order:

  • Quashed the order of the competent authority for disregarding the existing agreements.
  • Directed both parties to execute the conveyance deed and lease deed as per the original consent terms.
  • Imposed costs on the respondent society for their attempt to gain ownership beyond what was agreed upon in the consent terms.

This case underscores the importance of adhering to court-sanctioned agreements. Both parties are bound by the terms outlined in the consent decrees, and any attempt to deviate from them can have legal consequences.
