High Court of Delhi Approves Encrypted Video Recordings as Evidence.


In a recent order, the High Court of Delhi (Original Side) granted the plaintiff's motion to submit video recordings as evidence in an ongoing lawsuit. The Court's decision hinged upon Rule 24 of Chapter XI of the Delhi High Court (Original Side) Rules, 2018, which governs the admissibility of electronic records.

 

 

The order underscores the Registry's authority to accept video recordings on CD-ROMs, subject to them being encrypted with a robust hash function or demonstrably rendered in a non-editable format. This safeguard ensures the authenticity of the recordings and obviates any potential tampering with the evidence. The Court will upload the recordings to its secure server in a non-editable format, allowing the presiding judge to review them during the hearing.
