This case of Kadam GIrish Shriram Vs The Union of India & Ors., involves a petitioner who appeared for the NEET-PG 2024 examination and secured rank 112394. The petitioner was allotted a seat in the M.S. (General Surgery) program at ICARE Institute of Medical Sciences and Research, Haldia, under the Private Management Quota during the Special Stray Vacancy Round of online counselling.
A key point of contention was the petitioner's delayed reporting to the college. Although the petitioner paid the full fee of Rs. 27 lakhs online by the admission deadline of March 20, 2025, they reported to the college on March 27, 2025. The college disputed the reason for the delay, which the petitioner attributed to additional fee demands from the institution.
The High Court had dismissed the petitioner's writ petition, ruling that the candidate failed to report by the March 20, 2025 deadline. However, the Supreme Court, upon initial review, found that since the petitioner had paid the full fees by the deadline and was a duly counselled candidate, they should be considered admitted.
Given that the allotted seat remains vacant, the Supreme Court issued an interim order directing the ICARE Institute of Medical Sciences and Research, Haldia (Respondent No. 9) to allow the petitioner to attend classes starting from June 27, 2025. The petitioner is required to submit all necessary documents to the college by June 30, 2025. The matter is scheduled for further consideration on August 18, 2025.
