The claimant, aged 28, suffered 63% permanent disabilities due to a collision on March 23, 2007, while riding as a pillion passenger on a motorcycle. The accident involved a pickup truck driven by Chetan Ram, which resulted in severe injuries that necessitated ongoing medical treatment. A medical board confirmed the extent of the disabilities, indicating that the claimant faced significant challenges in mobility, speech, and daily activities.
Initially, the Motor Accident Claims Tribunal (MACT) awarded the claimant a compensation of ?15,51,000, based on documented annual earnings of ?1,00,000, as supported by income tax returns. The MACT calculated future losses using a multiplier method, reflecting the claimant’s age and level of disability.
However, in a subsequent appeal, the High Court revised this amount to ?7,35,000, citing guidelines from the Rajasthan State Legal Services Authority without sufficient grounds to dispute the income tax evidence presented. This reduction raised concerns about the principles governing compensation awards, particularly in cases where income can be substantiated.
The Supreme Court concluded that the MACT's original award was just and reasonable, reinstating the full compensation amount. The ruling underscores the judiciary's commitment to ensuring that victims of accidents receive fair and adequate compensation, reinforcing the importance of considering concrete evidence over arbitrary standards.
