Justice Served: Court Revokes Bail in Major Child Trafficking Case.


In a significant ruling, a higher court has intervened in a series of bail orders linked to a serious child trafficking case, emphasizing the need for justice in matters involving the safety of children.
The case centers around FIR No. 193 of 2023, concerning the disappearance of a four-year-old boy, which escalated into an investigation uncovering a child trafficking network. The initial inquiry led police to charge 14 individuals under various sections of the Indian Penal Code (IPC), including Sections 363 and 370(5), indicating the severity of the allegations.

During the proceedings, senior counsel Ms. Aparna Bhat represented the appellant, advocating against the bail granted to the accused on multiple occasions. She highlighted the organized nature of the trafficking operations, arguing that the circumstances warranted a reconsideration of the bail decisions made by the High Court.

 
 

The State of Uttar Pradesh, represented by counsel Mr. Garvesh Kabra, filed a counter affidavit detailing the breadth of the trafficking operations, which reportedly spanned across multiple states, including Uttar Pradesh, Jharkhand, and Rajasthan. The affidavit also presented evidence collected during the investigation, underscoring the accused's potential complicity in this heinous crime.

The court noted that the punishment for the charged offenses could range from a minimum of 14 years to life imprisonment, further stressing the gravity of the situation. Despite the serious implications, the High Court had previously granted bail without adequately considering the necessary legal parameters pertinent to such grave offenses.

In a decisive move, the court set aside the High Court's bail orders from October to December 2023, ruling that the accused must immediately surrender. It further instructed law enforcement to take necessary action should the accused fail to comply. This ruling marks a pivotal moment in the pursuit of justice for victims of child trafficking, reflecting a robust judicial approach to safeguarding the welfare of vulnerable children in society.
