Land Acquisition Compensation Boosted to Rs. 90,000 per Acre: Appeal Wins.

The appeal of R. Manohara Murthy & Others vs Assistant Commissioner & Land Acquisition Officer challenges a judgment passed by the High Court of Karnataka on 26th July 2021, which involved the compensation for land acquired for the expansion of an existing tank. The land, measuring 14 acres and 37 guntas in Yarabally village, was notified for acquisition in 2006, with the final notification issued in 2009. Compensation was initially set at Rs.23,000 per acre but was increased to Rs.35,000 per acre by the Reference Court. The High Court further raised it to Rs.66,000 per acre, using a base price of Rs.30,000 from a similar case in 1994, applying a 10% escalation for 12 years.
The appellants, dissatisfied with this, sought further enhancement. They presented a chart suggesting that, applying a 10% annual increase from the base price of Rs.30,000, the compensation should be approximately Rs.94,153 per acre. The appellants also argued that a similar land award from 2013 would yield compensation around Rs.2 lakh per acre, which, after adjusting for the time difference, would bring the amount down to about Rs.1.4 lakh per acre.
However, the Court decided to award a compensation of Rs.90,000 per acre, along with statutory benefits, and allowed the appeal accordingly.
