Madras High Court Registrar to Explain Bail Application Delay.

The Supreme Court in the matter of S. Balakrishnan & Another v/s State of Tamil Nadu, has taken note that the petitioners' main request for anticipatory bail in their Special Leave Petition has become infructuous due to their recent arrest. However, the petitioners' counsel has raised concerns about why their anticipatory bail application was not presented before the Madras High Court.
In response, the Supreme Court has issued a notice to the Registrar of the Madras High Court. The Registrar is directed to provide a report and a personal affidavit within four weeks, explaining the circumstances under which the petitioners' bail application was not brought before the Court. The Supreme Court emphasized that it is ultimately the Court's prerogative to determine the maintainability of such petitions. The matter will be listed for further hearing immediately after the four-week period.
