Given that the charge sheet and complaint would be filed by the ED/CBI within four weeks, the Vacation Division Bench of Aravind Kumar and Sandeep Mehta, JJ. granted Sisodia special leave to appeal against the Delhi High Court's decision in Manish Sisodia v. Enforcement Directorate, 2024 wherein the former Deputy Chief Minister and leader of the Aam Aadmi Party was denied bail in the money laundering and corruption cases related to the Delhi liquor Excise policy scam.
The Court further stated that each new application will be evaluated on its own merits when it is filed. The current case was brought by Sisodia after the Court gave him authority to file a new bail application in the event that the trial took a long time and advanced slowly over the following three months, starting on October 30, 2023. The prosecution guaranteed that the trial would be finished in six to eight months, hence the court granted the aforementioned liberty. He filed this current appeal with the court after his bail application was denied by both the Trial Court and the High Court.
The Court noted the Solicitor General's statement that the Trial Court would be free to move forward with the trial as soon as the investigation was completed and the final complaint and charge sheet was filed, preferably on or before March 7, 2024. In light of the aforementioned statement and the fact that the "6-8 months" period set by the Court in its Order of October 30, 2023, has not yet elapsed, the Court allowed Sisodia to resume his prayer upon the filing of the final complaint and charge sheet.
