Modification of Sentence and Compensation in Fatal Road Accident Case.


In Muthupandi Vs State Through The inspector of Police, Nilakottai Station, Dindigul, the appellant was convicted by the Madurai Bench of the Madras High Court for offenses under Sections 279 and 304(A) of the Indian Penal Code (IPC), relating to a fatal accident involving the appellant's rash driving, which resulted in the death of a man named Karthik and six cows. The appellant was sentenced to a fine and imprisonment, but on appeal, the sentence was reduced to three months of simple imprisonment. Despite being exempted from surrendering, the appellant deposited Rs. 1,00,000 as compensation for the deceased's family.

 

 

After considering the facts, including the time elapsed since the incident, the appellant's consistent bail status, and the compensation offered, the court modified the sentence. The conviction was upheld, but the sentence was changed to the transfer of the deposited amount of Rs. 1,00,000 (along with interest) to the mother of the deceased, in line with Section 357(3) of the Cr.P.C. The Principal District and Sessions Judge was tasked with ensuring the compensation reached the mother of the deceased.
