NDPS Accused Granted Bail, Citing Time Served and No Prior Record.


In Kamal Tailor Kamlesh Vs State of Rajasthan, the petitioner, an accused in FIR No. 101/2023 at Police Station Dug, Jhalawar, Rajasthan, was facing charges under Sections 8/20 and 8/29 of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act). The case involved the recovery of 43.275 kg of Ganja from a pillion rider on a scooter allegedly driven by the petitioner. The High Court had previously denied his bail application.

Upon appeal to this Court, and after considering that the petitioner has already spent two years and two months in jail and has no other criminal record, the Court decided to grant bail.


 
 
    


While the petitioner's counsel argued that the recovery wasn't made directly from the petitioner, the Court's decision primarily hinged on the significant period of incarceration already served and the lack of prior criminal antecedents.

Consequently, the petitioner is to be released on bail immediately under standard terms and conditions set by the concerned Court. The petition and all related applications are now disposed of.
