The Supreme Court has rejected appeals seeking renewal of three mining leases in Odisha, upholding the state government's decision. The leases, Kolha-Roida, Thakurani and Dalki, expired in 1994, 1996 and 2004 respectively.

Background:

The case involved Bird & Company Limited (Bird & Co.), which was granted the original mining leases. The rights were later transferred to Bharat Process & Mechanical Engineers Limited (BPMEL) due to nationalization. TPG Equity Management Private Limited (TPG), a creditor of BPMEL, challenged the rejection of the lease renewals. The leases had expired years ago, and BPMEL was ordered to be wound up in 1996 due to financial difficulties. TGP, claiming to be an assignee of a debt owed by BPMEL to UCO Bank, argued for lease renewal. Additionally, there were outstanding dues owed to workers from the mining operations.

Court Cites Impracticality for Renewal:

The Supreme Court, however, dismissed TPG's appeal. The Court pointed out the lengthy period of inactivity on BPMEL's part and its current status under liquidation. Furthermore, OMDC, a subsidiary of BPMEL, was deemed financially incapable of operating the mines. The Court concluded that renewing the leases without a viable plan and proper financial backing would be pointless. The Court prioritized ending the dispute due to the lack of a realistic path forward for resuming mining operations under the expired leases.

Workers' Claims and Debts Unaffected:

The Court's decision does not impact the rights of workers or TGP to pursue claims for outstanding dues. The proceedings regarding these debts will continue before the Company Court as per the Companies Act.

This judgement brings a close to a long-standing legal battle concerning the renewal of the mining leases. The Court's decision prioritizes practicality and prevents the continuation of a dispute with no foreseeable resolution.
