Out of the Games: Powerlifting Not Recognized for Government Sports Quota.

Two powerlifters in Maharashtra were denied government jobs under the sports quota reservation after a court ruling. The reason? Their sport, powerlifting, wasn't included in the latest list of qualifying games for the reservation.

The Petitioners had secured positions in a state powerlifting championship and applied for the jobs based on the quota. However, a government resolution (GR) issued in July 2016 limited the reservation to sports included in the Olympics, Commonwealth Games, and Asian Games.

Arguments and Rejections:

The Petitioners argued that a previous GR from 2005 allowed powerlifting for the quota. They also highlighted being recommended by the recruiting body and having their sports certificates verified. Additionally, they pointed out that other candidates were allegedly selected for powerlifting, suggesting a violation of equal opportunity.

 

 

The court, however, dismissed their petition. Here's why:

  • The latest GR (July 2016) takes precedence, and powerlifting isn't on the list.
  • A mere recommendation doesn't guarantee a job.
  • The status of other candidates' selection is under investigation and irrelevant to the petitioners' case.
  • Article 14 of the Constitution protects against discrimination, not claiming benefits from illegality.
  • The petitioners' certificate cannot be used after a clarification by authorities.
  • A later GR (March 2017) didn't supersede the latest GR.

Outcome:

The court's decision upholds the government's latest GR, leaving the Petitioners without the sports quota reservation. This case highlights the importance of staying updated on government policies, especially when applying for specific quotas or reservations.
