A Petitioner's challenge to a promotion denial was dismissed by the court. The Petitioner, who sought a position as Assistant Enforcement Officer, argued that outdated promotion rules should have been applied and that because a junior employee was allowed to take the promotion exam under the new rules, he should have been allowed to as well.
The court disagreed with both arguments. The Petitioner did not meet the service requirements under the old rules when the vacancies arose. While a junior employee was permitted to take the exam under a specific provision in the new rules, that provision only applied to employees who began working before a certain date. Since the junior employee failed the exam, the provision allowing senior employees to take the exam was not applicable.
The court acknowledged that the petitioner was eventually promoted to Assistant Enforcement Officer through a different process.
