Property Saved from Demolition as Court Grants Interim Relief.

A writ petition in the case of Jaya Tanwar Vs Municipal Corporation of Delhi & Another was filed to stop demolition actions against a property at WZ-1255-A, Nangal Raya, New Delhi, and to extend its temporary de-sealing. The petitioner's appeal regarding the property is still pending before the Appellate Tribunal Municipal Corporation of Delhi (ATMCD), but the tribunal cannot hear the case because it lacks a presiding officer.

A Show Cause Notice was issued on 1st May, 2025 by the Municipal Corporation of Delhi (MCD) which was followed by a Sealing Order on May 23, 2025, and the property was then sealed on June 18, 2025. The property was temporarily de-sealed twice at the petitioner's request, with the second period set to expire on September 4, 2025.
Given the circumstances, the court ordered that the temporary de-sealing of the property be extended until the ATMCD can hear and decide the petitioner's appeal. The court also instructed the MCD to avoid any demolition action until the appeal is resolved. This limited protection was granted because of the unusual situation where the appeal could not be heard by the ATMCD. The court made it clear that its decision does not reflect an opinion on the merits of the case, which will still be decided by the tribunal.
