Restoration of Dismissed Consumer Appeal on Conditional Cost.


In N. Ramesh Babu Vs Sare Homes Project Services Pvt. Ltd., Tamil Nadu, the Petitioner's initial appeal (No. 995 of 2023) was previously dismissed by the State Commission on 30.10.2024 on grounds of non-prosecution as no one appeared on behalf of the Appellant despite the presence of counsel being noted. The absence was attributed by the Petitioner as being due to personal difficulty and clarified that it was a first instance.
 


 
 

The higher forum, keeping this elucidation in view, revived the appeal but with a rider: the Petitioner is required to deposit Rs. 5,000 in the State Commission's Consumer Legal Aid Account within four weeks. Failing this payment within the period, the revision petition will stand automatically rejected.

The parties are ordered to stand before the State Commission on 18.08.2025, where the Petitioner is required to produce evidence of the deposit. The State Commission has been directed to continue with the case in terms of law. The revision petition and pending applications are disposed of by these orders.
