SC Dismisses Petition, Upholds High Court's Order on Non-Refund of Deposited Amount.

The petitioner’s appeal against his conviction is pending before the High Court, which, by an order dated 17.02.2022, suspended the conviction. However, the High Court also directed that an amount of Rs. 3,95,000/- deposited by the petitioner shall not be refunded to him even if the appeal is allowed.
The petitioner contended that the amount was deposited as a condition for the suspension of his conviction, but the Court found that this amount was not linked to the suspension of the conviction. Instead, the trial court had separately directed the petitioner to deposit Rs. 4,00,000/- for payment to witnesses, and the Rs. 3,95,000/- was deposited in connection with that order. Therefore, the High Court’s direction not to refund the deposited amount was upheld, and the Special Leave Petition was dismissed.
