The Supreme Court of India has cancelled the bail granted to Abdullah, Nasir and Muzammil by the High Court in a murder case. The court found that the High Court did not properly consider the details of the case before releasing the accused on bail.
The three men were accused of murdering Khursheed Ahmad. The FIR (First Information Report) named them specifically and a post-mortem report revealed the deceased suffered severe injuries. Despite this, the High Court granted bail to Abdullah after only four months in custody, citing the fact another accused had also been granted bail. Subsequently, bail was granted to Nasir and Muzammil based on Abdullah's bail. The Supreme Court found fault with this approach, noting the High Court hadn't considered each case individually.
The Supreme Court's decision comes after it previously cancelled bail for another co-accused in the same case. In its judgement, the Supreme Court emphasized that while the bail applications of Abdullah, Nasir and Muzammil were unsuccessful, this decision does not prejudice the overall case. The accused retain the right to file a new bail application at a later stage, which will be assessed on its own merits.
Abdullah, Nasir and Muzammil have been ordered to surrender to custody within 10 days.
