This case of Seeds Through Authorised Signatory Pattanagere Vs Govardhan Sukhdeo Deokar & Anr., involves a farmer (Respondent No. 1) who purchased bean seeds from a dealer (Respondent No. 2) supplied by the Petitioner. The seeds yielded a significantly reduced harvest due to low flowering rates, which an agricultural committee, including a university professor, attributed to defective seeds. The farmer filed a complaint with the District Consumer Disputes Redressal Commission, which ruled in their favor, ordering the Petitioner and the dealer to jointly compensate the farmer for their losses.
The Petitioner failed to file a written statement or present evidence at the District Commission, leading to an ex-parte ruling. The State Consumer Disputes Redressal Commission upheld this decision. The Petitioner then filed a revision petition arguing a lack of expert evidence and claiming the dealer should bear sole responsibility.
The National Consumer Disputes Redressal Commission dismissed the revision petition. They held that the Petitioner's failure to contest the agricultural committee's report, which included expert opinion, meant the report was sufficient evidence. They also rejected the excuse that the Petitioner's lawyer was at fault, as no supporting evidence was provided. The dealer’s absence and failure to contest further reinforced the finding of defective seeds. Consequently, the National Commission upheld the lower Fora's orders, finding no error in their decisions.
