Supreme Court Affirms High Court Ruling, Dismisses Petition on Non-Prosecution of Remanded Case.

The High Court disposed of the Second Appeal and Miscellaneous Single No. 5581/2004, observing that the judgment of the Board of Revenue was not appropriately dealt with by the Additional Commissioner and affirmed cursorily by the Tehsildar. The Court remanded the matter back to the Board of Revenue, directing it to consider the case in accordance with the law, particularly taking note of the pending civil proceedings. The revision before the Board of Revenue was restored, pending the decision of the civil court.


 

 
 
 


Upon remand, the suit was dismissed for non-prosecution. The petitioner filed an application for restoration of the suit, which is now pending. The petitioner’s counsel requested the Court to intervene, but considering the High Court’s reasoning and the current developments, the Supreme Court found no reason to interfere with the High Court’s decision. The Special Leave Petitions were dismissed, and any pending applications were disposed of.
