Supreme Court Directs Transfer of Criminal Trial in Rahul Sharma Case to Ensure Fairness.

The petitioner in Rahul Sharma v. State (NCT of Delhi) & Ors. contested the trial processes with the current Presiding Officer, claiming that they were unfair and opaque, and requested that the case be transferred. After the Delhi High Court denied his request, he filed the current appeal with the Supreme Court.

Following a hearing of both parties, the court ordered that the Principal District and Sessions Judge designate another court in Shahdara District, Karkardooma Courts, with comparable jurisdiction. The trial must be completed within three months, and the transfer must take place within a week.


 

 
 
 

The State promised full support in presenting witnesses, and the Court underlined that both sides must work together to prevent delays. Crucially, the petitioner promised not to make such accusations against judges or attorneys in the future and unreservedly retracted his accusations against the concerned Presiding Officer.

As a result, the petition and any outstanding applications were dismissed, and the Registry was instructed to notify the relevant District Court of the decision.
